Ștampila nu va mai fi obligatorie

Ministerul Finanțelor propune pentru consultări publice proiectul ordinului ce are drept scop excluderea din textul unor formulare tipizate obligativitatea de aplicare a ștampilei entității. Amintim, potrivit prevederilor Legii contabilității și raportării financiare nr.287/2017, printre elementele obligatorii ce urmează să le conțină documentele primare ștampila nu se regăsește. Și Legea nr.845/1992 cu privire la antreprenoriat şi întreprinderi stabilește că întreprinderile și întreprinzătorii nu sunt obligați să dețină și să aplice ștampila proprie pe înscrisuri de orice natură. În cazul în care legislaţia prevede necesitatea aplicării ştampilei, cerinţa se consideră îndeplinită dacă înscrisul este semnat de persoana împuternicită de întreprindere sau de către întreprinzător.

 

Astfel, necesitatea de aplicare a ștampilei urmează a fi exclusă din Ordinele aprobate anterior de Ministerul Finanțelor ce se referă la:

 

  • Indicaţiile metodice privind contabilitatea în cabinetele individuale ale medicilor de familie (OMF nr.181/2019)
  • „Avizul de însoţire a mărfii” şi a Dispoziţiilor privind modul de operare cu formularul tipizat de document primar cu regim special “Aviz de însoţire a mărfii” (OMF nr.65/2019)
  • Indicaţiile metodice privind contabilitatea pentru persoanele fizice care desfăşoară activitate profesională în sectorul justiţiei (OMF nr.216/2018)
  • formularul tipizat de document primar cu regim special „A-2/bi Bonul de comandă” (OMF nr.110/2011)
  • formularul tipizat de document primar cu regim special “Borderou de achiziţie al laptelui” şi a Instrucţiunii de completare a borderoului de achiziţie al laptelui (OMF nr.85/2014)
  • formularul tipizat de document primar „Act de confirmare a creanţelor şi datoriilor în valută străină aferente operaţiunilor economice între rezidenţii Republicii Moldova” (OMF nr.71/2014)
  • Regulamentul privind evidenţa contabilă a plantaţiilor viticole în procesul plantării, exploatării şi defrişării acestora (OMF nr.21/2014)
  • Regulamentul privind inventarierea (OMF nr.60/2012)
  • formularul tipizat de document primar cu regim special „Actul de achiziţie a serviciilor de locaţiune şi a cheltuielilor aferente“ (Ordinul comun al MF şi BNS nr.88/106/2008).

Proiectul poate fi consultat până la 22 iunie 2022.
