Sistemul sancţionator: proiectul modificărilor în Codul penal şi Codul de procedură penală

Partea I. Codul penal va fi completat cu un nou articol - 911, ce va reglementa liberarea de pedeapsă penală în cazul săvârșirii a unei infracțiuni pentru prima dată. Potrivit acestuia, persoana va fi liberată de pedeapsă penală în cazul săvârșirii unei infracțiuni econimice, dacă anterior nu a fost liberată de pedeapsă penală pentru aceeași faptă, dacă a înlăturat încălcările și a reparat prejudiciul în termenul stabilit de organul de control de stat al activităţii de întreprinzător și dacă a achitat la bugetul de stat o sumă egală cu valoarea prejudiciului material cauzat, dar nu mai mică decât dublul limitei maxime a amenzii prevăzute de sancțiunea articolului corespunzător. Pe de altă parte, articolul stipulează că persoana va fi liberată de pedeapsă penală doar dacă fapta nu a fost săvârșită prin aplicarea constrângerii psihice sau fizice, nu s-a soldat cu cauzarea de prejudicii vieții și sănătății persoanei sau nu a fost săvârșită de un grup criminal organizat sau organizație criminală. Codul penal va mai fi modificat la partea ce ține de evaziunea fiscală. Astfel, autorii propun reformularea componenței respective prin majorarea costului evaziunii fiscale de la 1500 u.c. la 6000 u.c, astfel încât să fie sporit gradul prejudciabil al faptei și să justifice includerea acesteia în Codul penal și stabilirea unui cadru temporal exact pe parcursul căruia a avut loc acțiunea de evaziune de un an. Codul de procedură penală va fi completat cu o prevedere prin care se interzice efectuarea perchezițiilor cu depășirea spațiilor, în temeiul altor acte sau urmărind alte scopuri, decât cele indicate în încheierea judecătorului de instrucție privind autorizarea percheziției sau în ordonanța procurorului. Această prevedere urmărește reglementarea foarte strictă a modului de efectuare a perchezițiilor și ridicărilor de obiecte și documente, stabilind astfel unele garanții care să evite abuzurile organului de urmărire penală și, în consecință, stoparea activității economice a persoanei. Totodată, art. 93 al Codului a fi completat cu o nouă prevedere, potrivit căreia procesul verbal, întocmit în urma procedurii de control de stat al activităţii de întreprinzător sau alt act de control cu caracter decizional, va avea valoare de probă în cadrul procesului penal. Notă: Proiectul modificărilor în legislaţie ce ţine de reforma sistemului sancționator în domeniul economic este elaborat de Ministerul Justiţiei, la propunerea Secretariatului Consiliului Economic pe lângă Prim-ministru.
