Are dreptul agentul economic la trecerea în cont a T.V.A. ce se referă la mărfurile aflate în stoc, dacă după procurarea mărfurilor cu aplicarea T.V.A. și primirea facturii fiscale (spre exemplu, un tractor), au fost efectuate modificări în legislația fiscală care stabilesc scutirea de T.V.A. pentru aceste mărfuri?
Conform art. 108 alin. (1) al CF, data obligaţiei fiscale privind T.V.A. este data livrării. Astfel, pentru mărfurile aflate în stoc, pentru care regimul T.V.A. a fost modificat după procurarea lor, regimul T.V.A. se va determina pornind de la prevederile legislației în vigoare la data livrării. Totodată, pe baza prevederilor art. 102 alin. (1) al CF, care stabilesc dreptul la trecerea în cont a sumelor T.V.A. achitate sau care urmează a fi achitate furnizorilor plătitori ai T.V.A. pe valorile materiale, serviciile procurate pentru efectuarea ...
