Contribuabilul nu este de acord cu activitatea postului fiscal, considerînd că organul fiscal nu are motive întemeiate de instituire a postului fiscal, şi intenționează să conteste postul fiscal respectiv. Este în drept contribuabilul să conteste postul fiscal? Dacă da, atunci care este procedura de contestare?
Unul din drepturile de care beneficiază contribuabilii în raporturile cu Serviciul Fiscal de Stat, potrivit art. 8 alin. (1) lit. g) din Codul fiscal, este contestarea, în modul stabilit de legislaţie, a deciziilor, acţiunilor sau inacţiunilor organelor cu atribuţii de administrare fiscală şi ale persoanelor cu funcţii de răspundere ale acestora. Astfel, chiar dacă legislaţia în vigoare nu stabileşte careva interdicţii de instituire a posturilor fiscale şi organul fiscal este în drept de a institui oricărui contribuabil post fiscal, în scopul prevenirii şi depistării ...
