Persoana fizică are sub tutela sa doi invalizi care se află în relații de rudenie reciprocă. Are oare dreptul tutorele de a beneficia de scutirea pentru persoanele întreținute în mărime de 9 120 lei, în cazul în care primește îndemnizația pentru întreținerea acestora?
Menționăm că, potrivit prevederilor art. 33 din Codul civil, tutela se instituie asupra persoanelor lipsite de capacitate de exerciţiu şi asupra minorilor în vîrstă de pînă la 14 ani, după caz. Odată cu atingerea de către minorul pus sub tutelă a vîrstei de 14 ani, tutela asupra lui încetează, iar persoana care a exercitat funcţia de tutore, în baza art. 47 din Codul civil, devine curatorul lui fără a fi necesară o hotărîre suplimentară în acest sens. Legislația fiscală (art. 35 CF) stabileşte că, tutorele şi curatorul minorilor în vîrstă de la 14 la 18 ani au dreptul la o scuti...
