Некоторые практические аспекты, касающиеся принудительного исполнения в отношении несобранной (будущей) сельскохозяйственной продукции
Процедура наложения ареста на несобранную сельскохозяйственную продукцию может быть применена к имеющим задолженность налогоплательщикам различных организационно-правовых форм, как к юридическим, так и к физическим лицам, осуществляющим предпринимательскую деятельность (индивидуальное предприятие, крестьянское (фермерское) хозяйство), а также к физическим лицам – гражданам. В соответствии со ст. 2011 Налогового кодекса, налоговый орган вправе арестовать несобранную сельскохозяйственную продукцию, за исключением продукции, предусмотренной в п. а) ч. (6) ст. 200 Налогового кодекса. Согласно п. а) ч. (6) ст. 200 Налогового кодекса, скоропортящаяся сельскохозяйственная продукция, в соответствии с перечнем, утвержденным Правительством, не может быть подвергнута аресту.
