Может ли субъект налогообложения использовать налоговые накладные старого образца, приобретенные (в порядке, установленном налоговым органом) в период до 2010 года?
В соответствии с п. 5 ПП № 294 от 17.03.1998, субъекты обязаны использовать новые типовые формы первичных документов строгой отчетности. Отметим, что, согласно этому же пункту, использование типовых форм, применяемых до 1 апреля 1998 г., запрещается. Согласно п. 6 Приказа Министерства финансов № 115 от 06.09.2010, вступившего в силу 01.11.2010 г., разрешается использование бланков налоговых накладных, действующих до вступления в силу данного Приказа, до полного использования остатков, находящихся в распоряжении субъектов обложения и Государственной налоговой службы. В то же время, в соответствии с п. 8 Приказа Министерства финансов № 115 от 06.09.2010, с 01.11.2010 отменяется совместный Приказ Министерства финансов № 32 от 11 марта 2002 г. и Департамента статистики и социологии № 30 от 13 марта 2002 г. об утверждении «Инструкции по заполнению типовой формы первичного документа строгой отчетности налоговой накладной для осуществле...
