Об определении налогового обязательства по подоходному налогу государственных предприятий и акционерных обществ с долевым участием государства
Применяются ли положения ст. 901 НК об удержании подоходного налога у источника выплаты с дивидендов и отчислений чистой прибыли государственных предприятий, а также акционерных обществ с долевым участием государства? В соответствии с положениями лит. g) ст. 8 Закона № 121-XVI от 04 мая 2007 г. об управлении публичной собственностью и ее разгосударствлении, в управлении государственными активами, к компетенции органов центрального публичного управления в области управления публичной собственностью относятся осуществление контроля над сохранностью и эффективностью использования государственного имущества в соответствующих отраслях, а также за правильностью начисления и своевременностью перечисления дивидендов, полученных по акциям (долям в уставном капитале) государства и доли чистой прибыли государственного предприятия.
