Care este responsabilitatea persanelor fizice pentru neprezentarea Declaraţiei cu privire la disponibilul de mijloace băneşti? Vor fi ele sancţionate de organele fiscale?
Depunerea declaraţiei este în beneficiul persoanei fizice, iar nedepunerea declaraţiei va duce la faptul că disponibilul existent la data de 1 ianuarie 2012, mai mare de 500 mii lei nedeclarat, va fi considerat, în cazul unor tranzacţii ulterioare, drept venit obţinut după 1 ianuarie 2012 şi, respectiv, va fi impozitat.

Налоговый кодекс прямо предусматривает, что данные, полученные вследствие использования косвенных методов, могут быть предоставлены только правоохранительным органам и судебным инстанциям, исключительно в случае рассмотрения дел, связанных с применением вышеуказанных методов.

Ce informaţie şi cui poate fi prezentată de organele fiscale? Vor avea sursele de informare în masă accesul la date statistice şi individuale despre aplicarea metodelor indirecte?
Codul fiscal expres prevede că datele, obţinute în urma utilizării metodelor indirecte, pot fi prezentate doar organelor de drept şi instituţiilor judecătoreşti, numai în cazurile examinării dosarelor legate de aplicarea acestor metode.

Cum Serviciul Fiscal de Stat va asigura securitatea informaţiei din declaraţiile privind disponibilul de mijloace băneşti?
Datele din Declaraţia cu privire la disponibilul de mijloace băneşti constituie secret fiscal şi legea prevede expres cazurile şi organele în care această informaţie poate fi furnizată. Pentru a asigura secretul informaţiei, s-a mers pe mai multe căi, inclusiv limitarea numărului de funcţionari fiscali, implicaţi în recepţionarea declaraţiei menţionate.
