Законом № 267 от 23.12.2011 г. внесены изменения в приложение 1 к разделу IX Налогового кодекса, согласно которым значительно увеличен сбор за пользование дорогами автомобилями, зарегистрированными в Республике Молдова. Согласно ст. XLIII данного закона, указанные изменения вступают в силу с момента опубликования закона – с 13 января 2012 года. Учитывая то, что данный сбор уплачивается до момента прохождения транспортным средством годового технического осмотра, за ряд автомашин, прошедших технический осмотр до 13 января 2012 года, сбор был уплачен по старым ставкам, действующим до 13 января 2012 года. Исходя из изложенного, возникает ли необходимость по автомобилям, прошедшим техническое тести-рование до 13 января, оплатить разницу между ставками, действующими до 13 января 2012 года, и ставками, вступившими в силу, начиная с 13 января 2012 года?
Luînd în considerație faptul că taxa menționată se achită pînă la data efectuării testării tehnice obligatorii anuale, o parte din mijloacele de transport au trecut testarea tehnică pînă la data de 13 ianuarie 2012 şi, respectiv, taxa a fost achitată conform cotelor vechi, în vigoare pînă la 13 ianuarie 2012. Reieşind din cele spuse, apare obligația de a achita diferența dintre taxele în vigoare pînă la 13 ianuarie 2012 şi taxele intrate în vigoare începînd cu 13 ianuarie 2012, în cazul autovehiculelor care au trecut testarea tehnică pînă la 13 ianuarie 2012?
