A fost votat un proiect de lege ce reglementează eficiența contractelor de garanție financiară

Vor fi reduse formalitățile la furnizarea și acceptarea garanțiilor financiare. Un proiect ce conține această prevedere a fost votat în lectură finală. Proiectul are scopul de a asigura certitudinea și eficiența contractelor de garanție financiară și de a facilita executarea garanției în cazul intentării procedurii de lichidare asupra furnizorului garanției. Conform proiectului, părțile pot conveni prin contractul de garanție financiară fără transfer de proprietate, cu privire la modul de evaluare a instrumentelor financiare și a creanțelor pecuniare. Executarea sau evaluarea garanțiilor financiare, precum și calcularea obligațiilor financiare garantate într-o manieră rezonabilă din punct de vedere comercial presupune asigurarea obținerii celui mai bun preț pentru respectivele garanții financiare. Proiectul legii prevede unele exceptări cu referire la obiectul contractelor de garanție financiară, cum ar fi apartenența la sistemul financiar atît a beneficiarului, cît și furnizorului garanției financiare, recunoașterea contractelor de garanție financiare cu transfer de proprietate, dreptul de utilizare a garanției financiare în temeiul contractelor de garanție financiară fără transfer de proprietate, inclusiv prin exercitarea dreptului de transfer a unei garanții echivalente. Proiectul va facilita utilizarea de către bănci a creanțelor pecuniare în calitate de garanții în cadrul operațiunilor de creditare ale băncii centrale. Autorii susțin că proiectul nu implică costuri suportate de bugetul de stat, iar anumite cheltuieli ar veni de la participanții la sectorul financiar care țin de adaptarea sistemelor informaționale ale acestora în cazul utilizării creanțelor pecuniare în calitate de garanții financiare. Prevederile proiectului de lege vizează reglementarea regimului juridic aplicabil contractelor de garanție financiară, executarea garanțiilor financiare și dreptul de utilizare a garanțiilor financiare.
