AEÎ și OCN sunt în drept să micșoreze DAE

Pe data de 27 martie 2020 a intrat în vigoare Hotărârea nr.13/5 a Comisiei Naționale a Pieței Financiare privind unele măsuri de atenuare a efectelor crizei epidemiologice, documentul fiind publicat în MO. Regulatorul stabilește că, în cazul în care o asociație de economii și împrumut (AEÎ) sau o organizație de creditare nebancară (OCN) va micșora cu cel puțin 5% dobânda anuală efectivă calculată conform contractului de credit (împrumut) acordat debitorilor până la data de 17 martie 2020 și nu va aplica penalități sau dobânzi de întârziere aferente creanței pretinse pentru perioada 17 martie 2020 – 31 mai 2020, entitatea este în drept să mențină provizioanele pentru pierderi la creditele (împrumuturile) respective acordate, potrivit clasificării efectuate la data de 17 martie 2020, pentru un termen de până la 31 decembrie 2020. CNPF precizează că micșorarea sumelor corespunzătoare poate fi efectuată unilateral de către AEÎ/ONC fără acordul debitorilor. În cazul în care plățile nu sunt achitate de către debitor/ locatar potrivit graficului prestabilit conform contractului de credit (împrumut)/leasing financiar aferente perioadei 17 martie 2020 – 30 iunie 2020, entitățile vizate pot menține, până la data de 30 iunie 2020, provizioanele pentru pierderi la aceste restanțe, conform clasificării la data de 17 martie 2020. Totodată, CNPF indică că modificarea până la 31 august 2020 a termenelor de scadență a plăților menționate supra (prin intermediul acordurilor bilaterale sau deciziilor unilaterale), dar care nu măresc obligația pecuniară a debitorului/ locatarului, nu va avea ca efect clasificarea acestora într-o categorie mai dură sau în categorii mai favorabile, decât cele existente la data declarării stării de urgență. În același timp, creditorii care au încheiate contracte de prestare a serviciilor informaționale cu birourile istoriilor de credit, urmează să raporteze acestor birouri starea de expirare a creditelor. În cazul adoptării deciziilor indicate supra, OCN și AEÎ vor asigura gestionarea eficientă a lichidității și gestionarea prudentă a altor riscuri aferente, se spune în document.
