Asigurarea socială: întrebări şi răspunsuri

Republica Moldova încheie acorduri bilaterale în domeniul asigurărilor sociale cu diferite ţări. Ce presupun aceste documente şi care sunt beneficiile pentru cetăţenii tării noastre? În prezent avem semnate 16 acorduri bilaterale în domeniul securităţii sociale, dintre care CNAS aplică 14 documente. Putem să diferenţiem aceste acorduri în două categorii: prima categorie ar fi acordurile bazate pe principiul teritorialităţii, iar cea de-a doua - pe principiul proporţionalităţii. În prima categorie de acorduri se includ acordurile cu Federaţia Rusă, Ucraina, Belarus, Azerbaidjan şi Uzbekistan, iar în a doua categorie - România, Portugalia, Bulgaria, Luxemburg, Austria, Estonia, Cehia, Polonia şi Ungaria. Încă două acorduri bazate pe principiul proporţionalităţii au fost semnate recent cu Belgia şi Lituania, însă acestea vor intra în vigoare după ce vor fi ratificate şi vor fi îndeplinite toate procedurile legale din partea ambelor state. Сum are loc, de fapt, stabilirea pensiilor conform acordurilor bilaterale bazate pe principiul teritorialităţii? De exemplu, persoana a realizat un stagiu de cotizare pe teritoriul Republicii Moldova, dar la atingerea vârstei de pensionare sau chiar după stabilirea pensiei a decis să-şi schimbe locul de trai permanent, în unul din statele cu care avem încheiate astfel de acorduri bazate pe principiul teritorialităţii. În acest caz persoanei i se va stopa dreptul la pensie în Republica Moldova şi îi va fi stabilită o altă pensie după noul loc de trai în statul de destinaţie în conformitate cu legislaţia acestui stat.
