Băncile nu vor mai putea intra în posesia bunurilor gajate de la datornici, decât dacă vor avea confirmarea înștiințării

Creditorii nu vor mai putea să-și exercite dreptul de ipotecă, așa cum o făceau până acum, doar anunțând în scris creditorii datornici. Curtea Constituțională a stabilit că această practică este, de fapt, neconstituțională. Obligatorie înainte de folosirea garanțiilor imobiliare va fi înștiințarea datornicilor prin scrisoare recomandată cu confirmare de primire. Astfel, în urma hotărârii Curții Constituționale din 27 septembrie creditorii nu mai pot susține că datornicii lor sunt informați, dacă au trecut 7 zile de la data trimiterii înștiințării privind intenția creditorului să-și exercite dreptul de ipotecă. Aceștia vor avea dreptul să facă uz de dreptul lor de ipotecă doar în baza înștiințării datornicilor prin scrisoare recomandată cu confirmare de primire. Sesizarea la Curtea Constituțională a fost depusă de avocații Igor Litvinenco și Dionisie Vition, iar procesul se află pe rolul Curții de Apel. Aceștia apără un grup de persoane, care se află în litigiu cu o instutuție bancară. Articolul care a făcut obiectul sesizării – art. 31, alineat 2 și 4 din Legea cu privire la ipotecă – prevede că notificarea se expediază debitorului ipotecar și, dacă este cazul, debitorului, prin scrisoare recomandată cu confirmare de primire. Potrivit aceluiași alineat, notificarea se va considera recepționată după 7 zile lucrătoare din ziua expedierii. În urma examinării sesizării, Curtea a menționat că articolele contestate sunt formulate de o manieră imprecisă și neclară și astfel nu corespund rigorilor de claritate și previzibilitate din Constituție, iar pentru a nu afecta securitatea raporturilor juridice se vor aplica regulile generale aplicabile procedurii de expediere a scrisorilor recomandate, stabilite de cadrul normativ privind comunicațiile poștale. Pentru a exclude situațiile în care debitorul ar putea să se eschiveze de la recepționare, Curtea va emite o recomandare Parlamentului pentru reglementarea procedurii de expediere și recepționare a notificării, astfel încât să garanteze, într-un mod echilibrat, drepturile ambelor părți contractante.
