Calcularea impozitului pe bunuri imobiliare la construcţia blocurilor noi

Pe parcursul a doi ani întreprinderea construiește un bloc, iar la 25.08.2018 perfectează procesul-verbal de recepție finală a încăperilor/apartamentelor noi, pe care îl înregistrează la organul cadastral la 30.08.2018. O parte din încăperi se predau investitorilor prin actele de primire-transmitere din 02.10.2018, iar unele dintre încăperi rămân în proprietatea companiei de construcție. Din ce dată și pentru care perioadă compania urmează ca să calculeze impozitul pe bunurile imobiliare? Conform prevederilor art. 277 alin. (2) din Codul fiscal, faptul că persoanele nu au executat obligația de înregistrare a drepturilor de proprietate, nu servește temei pentru nerecunoașterea acestora în calitate de subiecți ai impunerii cu impozitul pe bunurile imobiliare respective. Așadar, în acest caz, actul ce confirmă finisarea construcțiilor și atestă dreptul de proprietate asupra bunurilor imobiliare ale companiei este procesul-verbal de recepție finală a încăperilor/apartamentelor noi. Respectiv, doar pe bunurile care rămân în proprietatea companiei de construcții, impozitul pe bunurile imobiliare urmează a fi calculat din data Procesului-verbal de recepție finală, adică din 25.08.2018. Totodată, impozitul pe bunurile imobiliare pe încăperi/apartamente care se vor transmite beneficiarilor ori investitorilor se v-a calcula din aceiași dată de 25.08.2018, pentru persoanele fizice – cetățeni, de către Serviciul de colectare a impozitului pe bunurile imobiliare și de sine stătător – de către agenții economici.
