Câștigătorii procedurilor de achiziții publice vor declara beneficiarii efectivi

Ofertantul sau ofertantul asociat care va fi desemnat câștigător în cadrul unei procedurii de achiziție publică vor declara pe propria răspundere, sub sancţiunile aplicabile faptei de fals în acte publice, că beneficiarul/beneficiarii efectivi ai operatorului economic respectiv nu au fost condamnați prin hotărâre definitivă a unei instanţe judecătoreşti pentru participarea la activităţi ale unei organizaţii sau grupări criminale, pentru corupţie, fraudă şi/sau spălare de bani în ultimii 5 ani (de la data depunerii declarației).
 
Ministerul Finanțelor a elaborat și propune pentru consultări publice proiectul ordinului cu privire la aprobarea Declarației privind neîncadrarea beneficiarului efectiv în situația condamnării pentru participarea la activităţi ale unei organizaţii sau grupări criminale, pentru corupţie, fraudă şi/sau spălare de bani.

 

Astfel, în formularul declarației ce urmează a fi aprobat entitatea câștigătoare va indica numele, prenumele și IDNO al beneficiarilor efectivi, documentul fiind semnat de reprezentantul operatorului economic împuternicit să prezinte actul respectiv.

 

Declarația vă fi prezentată de câștigătorul desemnat în adresa Agenției Achiziții Publice în termen de cinci zile de la informarea operatorilor economici de către autoritatea contractantă despre rezultatele procedurii de achiziție publică, modul de prezentare fiind determinat de AAP.

 

Autorul proiectului propune punerea în aplicare a prevederilor acestuia din data publicării în MO.
