Codul Fiscal, modificat. Prevederi noi în legislație

Acestea au fost aprobate prin Legea nr. 292 din 16 decembrie 2016 și publicate în Monitorul Oficial al RM din 06.01.2017. Necesitatea modificărilor a parvenit în rezultatul adoptării Legii nr. 291 din 16.12.2016 Cu privire la organizarea și desfășurarea jocurilor de noroc. Astfel, urmare modificărilor efectuate, art. 20 lit. p1) din Codul Fiscal prevede în prezent neimpozitarea câștigurilor obținute de la campaniile promoţionale şi/sau din loterii. Anterior, neimpozabile erau doar câștigurile, valoarea cărora nu depășea suma scutirii personale. Conform art. 901 al. (33) din Codul Fiscal în redacție nouă, impozitul pe venit urmează să fie reținut și vărsat la buget de fiecare plătitor de câștig. Mărimea impozitului constituie 18% din suma câștigurilor de la jocurile de noroc, excepție fiind câștigurile de la campaniile promoționale și/sau din loterii și pariuri, care fac parte din veniturile neimpozabile. În baza redacției anterioare a acestui articol erau supuse impozitării în mărime de 18% câștigurile de la campaniile promoționale și/sau loterii, în partea care valoarea fiecărui cîștig depășea 10% din scutirea personală, stabilită prin art. 33, alin. (1), dar nu depășea 50 mii lei, și cu 25% - cele ce erau egale sau depășeau 50 mii lei. Tot prin Legea nr. 292 au fost efectuate modificări în Legea nr. 1227-XIII din 27 iunie 1997 cu privire la publicitate, conform cărora este interzisă publicitatea activităţii de întreţinere a cazinourilor, sălilor cu automate de joc şi a cîștigurilor băneşti, obţinute în rezultatul participării la acestea. Taxele de licenţă au fost stabilite în mărime de 600 de mii de lei pentru o masă şi 130 de mii de lei pentru ruletă. În acest sens au fost supuse modificărilor prevederile Legii nr. 451-XV din 30 iulie 2001 privind reglementarea prin licenţiere a activităţii de întreprinzător, anexa 1.
