Compania Red Union Fenosa a pierdut definitiv un proces pentru încălcarea Legii concurenței

Compania Red Union Fenosa a solicitat în instanță revizuirea cauzei în care a fost recunsocută vinovată pentru încălcarea Legii concurenței, anunțând că au apărut circumstanțe noi, pe care nu le-a cunoscut în timpul procesului. CSJ a lăsat însă în vigoare vechea hotărâre, ceea ce înseamnă încasarea la bugetul de stat a unei sume de 186 mii lei. Consiliul Concurenței a stabilit în urma unui control în anul 2011 că Red Union Fenosa ar fi comercializat alt tip de contoare, decât era prevăzut de lege și că ar fi obținut un venit de peste 1 mil. lei, fiindu-i astfel aplicată o amendă de 10 la sută din venitul acumulat. Deși au depus recursuri, avocații companiei au pierdut procesul în toate instanțele. Apărarea a încercat să demonstreze că amenda aplicată ar trebui să constituie 1 procent și nu 10, din cauza TVA-ului aplicat, dar și alte taxe care au afectat venitul brut. În luna iunie a acestui an compania a solicitat revizuirea cauzei, având la bază o scrisoare a Ministerului Finanțelor, care ar fi putut avea un rol decisiv în proces. Aceasta a fost emisă cu o lună mai devreme, însă în hotărârea CSJ nu se menționează ce conținea scrisoarea. Cererea de revizuire a fost respinsă, însă pe motiv că nu respectă temeiurile prevăzute de legislație și anume caracterul novatoriu al circumstanțelor, care nu puteau fi cunoscute atunci. Astfel, amenda de 186 mii lei, aplicată Red Union Fenosa, a rămas în vigoare.
