Cu privire la retragerea pensiei

Un cetăţean al Republicii Moldova o decis să se mute cu traiul permanent în una din ţările cu care a fost încheiat un acord bazat pe principiul teritorialităţii. Poate el să aleagă în care ţară va primi pensia? O condiţie de bază a acestui tip de acord este strămutarea locului permanent de trai pe teritoriul unuia dintre cele două state. Dacă, spre exemplu, persoana a ieşit la pensie în Republica Moldova şi din motive familiale este nevoit să-şi schimbe locul de trai permanent, fie în Federaţia Rusă sau Ucraina, ea cade sub incidenţa acestui tip de acord bilateral. Cetăţeanul nu poate trăi concomitent pe teritoriul Moldovei şi al Rusiei şi să beneficieze de pensie în Federaţia Rusă şi Moldova. Potrivit prevederilor în vigoare, persoanei care a plecat din Republica Moldova i se retrage pensia pe teritoriul ţării noastre şi i se stabileşte o pensie la noul loc de trai, conform legislaţiei acestui stat. Persoana care a atins vârsta de pensionare are posibilitatea să retragă din bugetul asigurărilor sociale toate contribuţiile pe care le-a transferat pe parcursul anilor cât a lucrat în altă ţară? Contribuţiile pot fi retrase doar din fondurile private de pensii, dar nu şi din fondurile de asigurări sociale de stat. Acordurile bilaterale în domeniul asigurărilor sociale semnate de către Republica Moldova prevăd doar prestaţii de asigurări sociale de stat şi îi vizează doar pe acei cetăţeni care sunt asiguraţi în sistemul public de asigurări sociale.
