Curtea Constituțională: amenzile economice aplicate unor companii de construcții sunt ilegale

Inspecția de Stat în Construcții nu are pârghii legale pentru a aplica amenzi companiilor care au încheiat contracte cu instituții publice și care sunt suspectate că au majorat artificial volumul lucrărilor. Curtea Constituțională a emis o decizie în acest sens. Curtea a recepționat două sesizări la același subiect. Administratorii companiilor de contrucții s-au plâns că au fost amendați practic dublu de Inspecția de Stat în Construcții pentru faptul că ar fi majorat artificial volumul de lucrări și astfel ar fi beneficiat de bani publici. Mai exact, suma care se considera că a fost obținută ilegal era confiscată, plus la aceasta companiei i se aplica o amendă similară cu valoarea sumei confiscate. Inspecția făcea trimitere la Regulamentul privind exercitarea controlului asupra utilizării investiţiilor publice în construcţii. Curtea a observat că deși Legea privind calitatea în construcții stabilește temeiurile pentru atragerea la răspunderea penală, administrativă și patrimonială, acestea nu prevăd perceperea de la antreprenor a unei amenzi în mărimea încasării la bugetul de stat a sumelor obţinute nelegitim și nici nu abilitează Inspecția de Stat în Construcții cu dreptul de a aplica asemenea amenzi. Curtea a reținut că Guvernul, fiind autoritate a puterii executive, are rolul de a adopta hotărâri pentru organizarea executării legilor. Astfel, Legea Supremă nu abilitează Guvernul cu dreptul de a institui norme primare. Prin urmare, Guvernul şi-a depăşit competenţele, încălcând dispoziţiile art.102 combinat cu art. 72 lit.n) din Constituţie, se menționează într-un comunicat al Curții Constituționale. Adiţional, Curtea a subliniat că prevederile Legii nr.721-XIII din 2 februarie 1996 privind calitatea în construcţii nu reglementează în mod detaliat atribuțiile Inspecţiei de Stat în Construcţii, în special ceea ce ține de aplicarea sancțiunilor. În acest sens, Curtea va emite o Adresă Parlamentului pentru a reglementa suplimentar competențele acesteia.
