Декларация о подоходном налоге: форма DPJ

Государственная Налоговая Служба разработала и представила для публичных консультаций проект приказа Министерства Финансов Об утверждении декларации о подоходном налоге для лиц, осуществляющих профессиональную деятельность в сфере правосудия, а также метод ее заполнения. Проект декларации разработан для 10 видов профессиональной деятельности. Нотариусы, судебные исполнители, адвокатские кабинеты, объединенные адвокатские бюро, адвокаты-стажеры, авторизованные управляющие и их объединенные бюро, медиаторы и бюро медиации, а также переводчики и синхронные переводчики обязаны будут предоставить новую форму декларации, после ее утверждения и вступления в силу. Помимо общепринятой в подобного рода формуляров информации (налоговый период, название налогоплательщика и его фискальный код, наименование подразделения ГНС, указание доходов и расходов по различным статьям), проект включает ряд приложений к декларации. Так, приложение 1D является справкой к строке 20 декларации о доходах и предусматривает расшифровку корректировок (увеличения либо уменьшения доходов) в соответствии с налоговым законодательством. Это могут быть доходы, полученные в результате изменения метода учета в соответствии с положениями ст.44 ч.8 Налогового кодекса; аннулированные пени и штрафы, определенные законодательными актами как необлагаемые налогом; доход от непогашения задолженности хозяйствующим субъектом как следствие возникновения неплатежеспособности налогоплательщика и др. Приложение 2D предусматривает указание корректировок (увеличения либо уменьшения доходов) связанных с личными и семейными расходами, расходами на страхование, командировки, расходы связанные и выплатой либо начислением процентных ставок, убытки от реализации основных средств, расходы по оплате пени и штрафов, наложенных в результате несоблюдения действующего законодательства, пожертвования на дарения и т.д. Приложение 2.1D расшифровывает представительские расходы, приложение 2.2D – льготы, предоставляемые работодателем. Приложение 3D является ежеквартальным расчетом суммы подоходного налога, подлежащего уплате в рассрочку за год, следующего за отчетным. Также лица, осуществляющие профессиональную деятельность в сфере правосудия, обязаны будут представить информацию о суммах освобождений, предоставленных учредителям компании и членам их семей. Обязательным станет раскрытие информации о доходах, полученных за рубежом, и уплаченных там налогах. Первым налоговым периодом, за который следует представить данную декларацию, является 2017 год. Также следует отметить, что налогообложение лиц, осуществляющих деятельность в области правосудия является новым положением, включенным в Бюджетно-налоговую и таможенную политику на 2017 г. Также в Налоговый кодекс был включен раздел 101, который предусматривает налогообложение этого вида деятельности. Документ доступен для обсуждения до 20 марта текущего года.
