Декретный отпуск – не повод для увольнения местного избранника

Правительство дало положительное заключение по проекту законодательной инициативы группы депутатов, направленной на устранение существующих пробелов в законодательстве, которые допускали дискриминацию в отношении женщин, избранных в местные органы власти. Поправки касаются Закона о статусе местного выборного лица, Закона о местном публичном управлении и Трудового кодекса. В частности, предложено не допускать досрочного прекращения полномочий председателя района, его заместителя, примара и заместителя примара в случае выхода в отпуск по беременности или родам. Действующее законодательство оговаривает случаи досрочного прекращения полномочий местных избранников. Это нарушение Конституции, законодательства или интересов местного сообщества; несовместимость должностей; конфликт интересов; неподача декларации об имуществе и личных интересах или отказ от ее подачи; по решению судебной инстанции и вступлении в силу вынесенного обвинительного приговора; подача в отставку или смерть. При этом не оговорены исключения для случаев, когда местный избранник - женщина, которая может воспользоваться своим правом на рождение ребенка и на положенный в связи с этим отпуск по беременности и родам. Соответственно, женщину-председателя района, ее заместителя, примара и заместителя примара в случае выхода в декретный отпуск могут отправить в отставку досрочно в случае выхода в декретный отпуск. Это создает дискриминационные условия в отношении женщин, избранных на руководящие посты в местные органы власти. Согласно законопроекту, в законодательство будет внесено уточнение о том, что досрочное прекращение полномочий местных избранников предпринимается в случае невозможности исполнения им своих обязанностей на протяжении более четырех месяцев подряд, в том числе из-за болезни, за исключением нахождения в отпуске по беременности и родам. Однако данное положение не будет применяться в отношении заместителя примара, исполняющего свои обязанности на общественных началах. Правительство поддержало эту законодательную инициативу, проект предстоит утвердить на заседании парламента.
