Электронная подпись укрепляет свои позиции в органах публичной власти

На этой неделе Правительство одобрило два постановления, касающиеся применения электронной подписи - постановление об утверждении Положения о применении цифровой подписи в электронных документах служащих юридических лиц публичного права в рамках их электронного оборота, а также постановление об утверждении Положения о деятельности поставщиков сертификационных услуг в области применения электронной подписи. Оба документа являются нормативными актами и разработаны с целью приведения в соответствие законодательства в этой области с последними внесенными изменениями. Так, первое положение устанавливает правила применения цифровой подписи в рамках органов публичной власти, определяет ответственных лиц за создание пары ключей, их сертификацию, подпись электронных документов, проверку аутентичности электронной подписи и пр. Документ определяет права и обязанности ответственного за эту деятельность работника органа публичной власти, содержит требования по обеспечению безопасности электронной подписи и электронного документооборота, устанавливает принципы разрешения спорных ситуаций. Второе положение регулирует применение электронной подписи и деятельность поставщиков сертифицированных услуг в области применения электронной подписи. В этом нормативном акте оговорены способы аккредитации поставщиков сертификационных услуг, описаны принципы организации их деятельности, процедуры прекращения деятельности поставщиков этих услуг. Положение также регулирует деятельность поставщиков сертификационных услуг высшего уровня, а также поставщиков сертификационных услуг органов публичной власти. Конкретизированы их основные функции, ответственные учреждения за создание и администрирование этих услуг, источники финансирования. В частности, этим положением за Службой информации и безопасности Молдовы закреплен статус поставщика сертификационных услуг высшего уровня, а за ГП «Центр специальных телекоммуникаций» - поставщика сертификационных услуг органов публичной власти. Стоит отметить, что, после вступления в силу двух названных положений, утратят силу действующие сегодня аналогичные нормативные акты в этой области (постановление Правительства о центрах сертификации открытых ключей, постановление об утверждении Положения о предоставлении услуг телекоммуникационной системы органов публичного управления и внесении изменений в некоторые постановления Правительства, Положение о порядке применения цифровой подписи в электронных документах органов публичной власти и пр).
