Электронная торговля узаконена

Закон «Об электронной торговле» опубликован 9 февраля в «Официальном мониторе Республики Молдова». Документ устраняет имевшиеся пробелы, а положения закона приведены в соответствие с Соглашением об ассоциации между Республикой Молдова и Европейским союзом. Закон устанавливает принципы регулирования электронной торговли, условия предоставления услуг информационного общества, ответственность поставщиков услуг и посредников, а также принцип поддержки сотрудничества между Республикой Молдова и другими странами в процессе предоставления услуг информационного общества. Закон также содержит положения о защите персональных данных. При их обработке поставщики услуг обязаны соблюдать режим конфиденциальности данных, предпринимать организационные и технические меры, необходимые для защиты персональных данных от незаконного или случайного доступа к ним. В то же время закон оговаривает условия размещении заказа. Если получатель услуг размещает заказ с помощью электронных средств, поставщик услуг должен подтвердить без промедления, посредством тех же электронных средств, получение информации о заказе, включая согласие получателя услуг или его отказ от заказа. Надзор и контроль за соблюдением норм по защите прав потребителей в данной сфере возложен на Агентство по защите прав потребителей. Контроль законности обработки персональных данных в сфере электронной торговли осуществляется Национальным центром по защите персональных данных. Применение нового закона предоставит больше возможностей для развития онлайн-торговли в нашей стране и обеспечит стимулирование экономического роста предприятий, увеличение инвестиций в инновационные технологии, развитие электронных систем и поспособствует повышению конкурентоспособности молдавских предприятий. Закон вступит в силу через три месяца с момента его опубликования. В течение этого срока Правительство представит парламенту предложения по приведению действующего законодательства в соответствии с нормами нового закона.
