Градостроительный сертификат будет выдан без нотариально заверенного согласия собственников земельных участков

В Молдове вступил в силу Закон провозглашении общественной полезности работ национального значения по строительству газопровода Унгены-Кишинев. Речь о втором этапе реализации проекта по соединению газотранспортных систем Румынии и Молдовы. В то же время, большинство положений этого закона вступит в силу с 31 августа 2017 г., а с 30 июня, после публикации документа в Monitorul Oficial, вступила в силу только его часть: в отступление от Закона о разрешении строительных работ, Министерство регионального развития и строительства выдаст градостроительный сертификат для проектирования работ по строительству газопровода Унгены-Кишинев без нотариально заверенного согласия собственников земельных участков, интересы которых могут быть затронуты в процессе строительства, а процедура экспроприации осуществляется в соответствии с Законом об экспроприации. Закон оговаривает экспроприацию земельных участков, находящихся в частной собственности и в собственности административно-территориальных единиц, расположенных на территории, по которой будет проложен газопровод Унгены-Кишинев. В частности, газопровод пройдет через пригороды Кишинева - коммуны Тогатино, Ставчены, Гратиешты, с.Гидигич, а также через села Сирец, Рошкань, Негрешть, Кэприяна, Ворничешты и коммуны Рэдень, Келэуза, Пэнэшешть в Страшенском районе, коммуну Тузара, села Питушка, Нишкань, Темелеуць, Петичень, Вэлчинец, Садова и г. Калараш в Каларашском районе, с. Милешты в Ниспоренском районе, коммуны Алексеевка, Пырлица, Тодирешты, Рэдений Векь в Унгенском районе. Со дня вступления в силу этого закона будет наложен запрет на отчуждение подлежащих экспроприации земельных участков или передачу права пользования ими, за исключением их передачи в собственность или пользование государства. Согласно предварительным оценкам, на выплату компенсаций потребуется около 600 тыс. евро. Работы по проектированию и строительству газопровода Унгены-Кишинев будут финансироваться за счет кредитов, предоставленных Молдове Европейским банком реконструкции и развития, Европейским инвестиционным банком, а также за счет гранта Евросоюза.
