Guvernul a aprobat proiectul legii privind exercitarea unor activităţi necalificate cu caracter ocazional desfăşurate de zilieri

Documentul are drept scop reglementarea activităţilor necalificate cu caracter ocazional ale zilierilor, pentru diminuarea fenomenului muncii informale şi respectarea drepturilor zilierilor din Moldova. Proiectul reglementează drepturile şi obigaţiunile angajatorilor în privinţa zilierilor care exercită activităţi necalificate ocazionale, cu derogare de la Codul muncii. Domeniul în care poate fi exercitată activitate necalificată ocazională este agricultura. Potrivit documentului, munca zilnică a unui zilier nu poate depăşi 8 ore şi, respectiv, 5 ore în cazul minorilor de 15-16 ani, 7 ore pentru cei de 16-18 lei. Minorii de 15-16 ani vor putea efectua munci ocazionale doar cu acordul în scris al părinţilor sau reprezentanţilor legali, dacă acest lucru nu le afectează sănătatea, dezvoltarea, instruirea, etc. În funcţie de vârstă, durata muncii zilierilor nu trebuie să depăşească 40, 35 sau 25 de ore pe săptămână. Durata activităţii ocazionale a zilierilor trebuie să fie de cel puţin o zi dar nu mai mult de 90 de zile pe durata unui an calendaristic pentru acelaşi beneficiar. Potrivit proiectului de lege, zilierul primeşte pentru munca sa un salariu, al cărui mărime este stabilită prin negocieri directe dintre părţi. În acelaşi timp, mărimea remunerării pentru o zi de muncă (8 ore) nu poate fi mai mic decât minimumul garantat pentru munca pe oră din sectorul real al economiei. Iar angajatorul este obligat să remunereze zilierul la sfârşitul fiecărei zile de muncă, să plătească impozitul pe venit, să ţină registrul zilierilor şi să transmită extrase din acest registru Inspecţiei muncii. Potrivit documentului, beneficiarii trebuie să le asigure zilierilor mijloace individuale de protecţie, iar în cazul accidentelor la locul de muncă – să acţioneze conform legislaţiei.
