Guvernul a susţinut proiectul ce prevede ajustarea cadrului legal la pogramul Agent economic autorizat

Proiectul a fost elaborat în urma recomandărilor experţilor Comisiei Europene şi se referă la corespunderea Programului Agent economic autorizat (AEO) din Republica Moldova cu cel al Uniunii Europene, în perspectiva recunoaşterii reciproce a agenţilor economici autorizaţi între ţara noastră şi UE. Astfel, prin acest proiect se propune aprobarea formularului de cerere privind acordarea statutului de Agent economic autorizat, conform prevederilor noului Cod Vamal al UE nr. 952/2013, inclusiv normele de completare a acestora, cazurile de neacceptare a cererii, aprobarea regulamentului privind logo-ul AEO etc. În acest sens, urmează a fi modificată Hotărârea Guvernului nr. 647 din 7 august 2014 Privind punerea în aplicare a prevederilor secțiunilor 271 și 281 din Codul vamal al Republicii Moldova. Proiectul conţine propuneri de modificare şi completare a procedurii de autorizare a operatorilor economici autorizaţi. Modificările respective simplifică şi oferă mai multă eficienţă procedurilor vamale. Implementarea proiectului dat nu necesită resurse financiare bugetare şi nu prevede reorganizarea instituţională, a menţionat Ministrul Finanţelor, Octavian Armaşu. Conform proiectului, solicitantul va depune, în mod obligatoriu, chestionarul de autoevaluare pentru acordarea statutului de Agent economic autorizat, completat conform modelului stabilit de Serviciul Vamal, iar Serviciul Vamal, din momentul recepționării cererii și documentelor anexate, în termen de 10 zile lucrătoare, va verifica informațiile prezentate și va decide asupra acceptării acesteia. Cererea va fi acceptată dacă solicitantul este rezident în sensul art.5 pct.5 din Codul fiscal şi este înregistrat la organele vamale ca participant la activitatea economică externă. Proiectul prevede ca în cazul în care se constată că cererea nu conține toate informațiile necesare, Serviciul Vamal cere solicitantului să furnizeze informațiile relevante într-un termen-limită, care nu depășește 30 de zile calendaristice de la data primirii cererii. Solicitantul este obligat să furnizeze Serviciului Vamal toate informaţiile şi documentele care atestă îndeplinirea condiţiilor de acordare a statutului AEO, conform art.1953 din Codul vamal al Republicii Moldova. Proiectul prevede că în cazul necorespunderii cu oricare dintre condițiile prevăzute la art.1953 din Codul vamal al RM, orice decizie luată în ceea ce privește AEO care se bazează pe autorizația AEO în general sau pe oricare dintre condițiile specifice, este suspendată de către Serviciul Vamal.
