Guvernul nu a susținut un proiect ce prevede modificarea Codului Fiscal

În Monitorul Oficial din 27 ianuarie curent a fost publicat Avizul la proiectul de lege pentru completarea articolului 42 din Codul fiscal nr.1163-XIII din 24 aprilie 1997. Proiectul de lege ( nr.441 din 25 noiembrie 2016), care a primit avizul negativ din partea Guvernului este semnat de un grup de deputați și prevedea introducerea unui nou alineat în Codul Fiscal care prevede acordarea unor scutiri de plata impozitului pentru creșterea de capital. Astfel, deputații au propus ca, creșterea sau pierderea de capital să nu fie recunoscută în cazul încheierii unui contract de donație între rude până la gradul III, inclusiv între soți. În acest context, Ministerul Finanțelor a venit cu câteva precizări. Obiectivele politicii fiscale şi vamale pe termen mediu 2017 – 2019, ca parte componentă a Cadrului bugetar pe termen mediu (2017-2019), aprobat prin Hotărârea Guvernului nr.1011 din 26 august 2016, prevede revizuirea mecanismului de impozitare a veniturilor sub formă de creştere de capital pentru persoane fizice prin simplificarea aplicării acestuia și excluderea submecanismelor costisitoare în administrare și conformare. Totodată, conform Avizului, Legea nr.281 din 16 decembrie 2016 cu privire la modificarea şi completarea unor acte legislative (în partea ce ţine de realizarea politicii fiscale şi vamale pentru anul 2017 şi perfecţionarea legislaţiei fiscale şi vamale) prevede expunerea art. 37-42 din Codul fiscal într-o nouă redacție. De asemenea, noua redacție a art.40 din Codul fiscal prevede că, în cazul încheierii unui contract de donații între rude de gradul I, precum și între soți, creșterea sau pierderea de capital nu este recunoscută în scopuri fiscale. Astfel, proiectul înaintat de deputați nu a fost susținut de Guvern în ședința sa din 25 ianuarie 2017.
