Guvernul susține modificarea Legii cu privire la întreprinderea de stat și municipală

Guvernul a aprobat în ședința din 1 august avizul la proiectul de lege pentru modificarea Legii cu privire la întreprinderea de stat și întreprinderea municipală Reamintim că un grup de deputați au elaborat o inițiativă legislativă ce prevede mai multe modificări la legea menționată, inclusiv auditul extern obligatoriu al situațiilor financiare la întreprinderile de stat și municipale. Astfel, Guvernul susține proiectul, în condițiile unor propuneri de îmbunătățire. Acest proiect de lege a fost elaborat de un grup de deputați pentru a înlătura unele lacune din legislația actuală ce reglementează organizarea și funcționarea întreprinderilor de stat și municipale, în special ceea ce ține de transparență, accesul la informații, achiziții, evitarea conflictului de interes. Documentul a fost examinat de autoritățile competente în domeniu, în special Ministerul Economiei și Infrastructurii și Agenția Proprietății Publice și avem un aviz consolidat la proiect, a menționat ministrul Finanțelor, Natalia Gavrilița. Guvernul propune excluderea din proiect a prevederii prin care se impune realizarea de către întreprinderile de stat și municipale a procedurilor de achiziție prin sistemul de achiziții publice, din considerentul că întreprinderile nu exercită expres calitatea de autoritate contractantă, iar transparența procedurilor de achiziție este asigurată prin Regulamentul privind achiziționarea bunurilor, lucrărilor și serviciilor la întreprinderea de stat, precum și prin Regulamentul privind achiziționarea bunurilor, lucrărilor și serviciilor la întreprinderea municipală. În ceea ce privește inițiativa autorilor de a include cerința de audit obligatoriu pentru toate întreprinderile de stat/municipale, se propune a lua în considerare faptul că o parte din întreprinderi, din lipsa resurselor financiare pentru achiziționarea serviciilor de audit, nu vor fi în stare să respecte această obligație, deoarece serviciile de audit sunt costisitoare, se spune în avizul Guvernului.
