И снова о патентах на розничную торговлю

Группа депутатов предлагает разрешить до конца 2022 г. предпринимательскую деятельность на основе патентов для некоторых видов торговли. Речь идет о розничной торговле с лотков, прилавков, из палаток, киосков (ларьков), павильонов и автомашин, а также реализации пищевых продуктов и скоропортящихся товаров отечественного производства при условии соблюдения санитарно-эпидемиологических требований их складирования, хранения и реализации. Соответствующая законодательная инициатива зарегистрирована на этой неделе в парламенте. Осуществление указанных видов деятельности, согласно действующей редакции Закона о предпринимательском патенте, разрешена только до 31 декабря 2018 г. и только патентообладателям, обладающим по состоянию на 31 декабря 2016 г. патентом на соответствующий вид деятельности. Деятельность на основе патентов разрешена исключительно в пределах авторизированных торговых рынков, созданных в соответствии с Законом о внутренней торговле. Если законопроект будет одобрен, то патентообладателям на эти виды деятельности разрешат розничную торговлю еще на три года. В пояснительной записке к проекту говорится, что сегодня далеко не все разрешенные местными органами власти места для осуществления розничной торговли соответствуют специфическим требованиям Закона о внутренней торговле, который в некоторых случаях ограничивает в действиях как представителей местных властей, так и пантообладателей. Существующие неясности создают конфликт между представителями центральных и местных властей, а также налоговыми органами и патентообладателями, и становятся причиной для наложения штрафов на последних. Отмечается, что Министерство экономики и инфраструктуры так и не предложило малым предпринимателям альтернативные виды деятельности, а патент является наиболее простым путем законного получения дохода для граждан. Продление сроков осуществления розничной торговли на основе патентов позволит патентоообладателям работать легально, сохранить рабочие места, а также повысить объемы розничной торговли на внутреннем рынке, которые в 2017 г. сократились на 3,8%. По данным Государственной Налоговой Службы, на конец 2016 г. в Молдове действовало 11 454 патента на розничную торговлю, что составляет 65,3% от общего числа выданных и действующих патентов.
