Indicațiile metodice privind efectuarea vizitelor fiscale vor fi modificate

Serviciul Fiscal de Stat a elaborat și propune spre consultare un proiect de ordin de modificare a Indicațiile metodice privind efectuarea vizitelor fiscale, aprobate prin Ordinul SFS nr. 388/2019.  

 

Astfel, după finalizarea vizitei fiscale, funcționarul fiscal va perfecta Raportul vizitei fiscale sau, după caz, Raportul vizitei fiscale privind înregistrarea ca subiect al impunerii cu TVA/Raportul vizitei fiscale privind înregistrarea în calitate de antrepozitar autorizat/Raportul vizitei fiscale de constatare a adresei juridice/adresei subdiviziunilor și Procesul verbal de observare directă a activității contribuabilului,  în funcție de scopul vizitei fiscale, în care se consemnează datele și faptele constatate și subiectele discutate în cadrul vizitei fiscale.

 

 
Raportul și procesul - verbal se vor întocmi în termen de până la 3 zile lucrătoare după finalizarea vizitei fiscale în două exemplare, fiind semnate de către funcționarul fiscal și reprezentantul contribuabilului. Primul exemplar se păstrează la SFS, iar al doilea se înmânează contribuabilului, contra semnătură.

 

 
În cadrul vizitei fiscale se va examina perioada aferentă ultimelor 12 luni de activitate a contribuabilului (cu excepția cazurilor în care sunt necesare informații pentru perioade anterioare). Dacă agentul economic în perioada de 12 luni de activitate a fost supus unei vizite fiscale, următoarea va fi efectuată de la data ultimei vizite.

 

 
Propunerile și sugestiile la proiectul de ordin pot fi remise la adresa electronică elena.vozian@sfs.md, până la data de 14 septembrie curent.

 

 
Indicațiile metodice privind efectuarea vizitelor fiscale sunt elaborate în scopul executării prevederilor art. 133 alin. (1) pct. 13) și art. 134 alin. (1) pct.3) din Codul fiscal și reprezintă un suport pentru funcționarii SFS în cadrul efectuării vizitei fiscale şi stabilesc particularitățile şi condițiile de organizare, efectuare şi de raportare a rezultatelor vizitei fiscale.
