Înregistrarea divorțului de către misiunile diplomatice

Spectrul serviciilor prestate de către misiunile diplomatice şi oficiile consulare ar putea fi extins prin înregistrarea divorțului. Un proiect în acest sens a fost inclus pe agenda secretarilor generali din 11 februarie curent.
 
Astfel, se propune completarea Legii cu privire la taxele consulare (anexa nr.2, compartimentul IV, poziția 2) cu serviciul ce se referă la înregistrarea divorţului în temeiul cererii comune a soţilor, în cazurile în care între aceștia nu există neînțelegeri referitoare la partajul proprietății comune în devălmășie, la întreținerea, educația și domiciliul copiilor minori comuni sau la întreținerea unuia dintre soți. Pentru acest serviciu se va percepe o taxă de 250 lei.

 

Proiectul vine să ajusteze legislația în corespundere cu noile modificări în Codul Familiei și ale Legii privind actele de stare civilă.

 

Potrivit notei informative a proiectului, anterior se permitea desfacerea căsătoriei în baza cererii ambilor soți la misiunile diplomatice şi oficiile consulare și oficiile stării civile numai în cazul când soții nu aveau copii minori comuni sau înfiaţi de ambii soţi, cu condiția că între aceştia nu existau litigii referitoare la partaj sau la întreţinerea soţului inapt de muncă.
