Înstrăinarea și înregistrarea bunurilor imobile, fără certificatul de la SFS

Contractul de înstrăinare şi contractul de gaj al bunurilor supuse înregistrării se va autentifica cu condiţia prezentării documentelor care confirmă dreptul de proprietate asupra acestor bunuri şi a extrasului din registrul gajului despre lipsa grevării acestor bunuri. Deputații și-au reconfirmat în ședința de ieri votul pentru proiectul ce prevede optimizarea procedurilor de înstrăinare și înregistrare a bunurilor imobile prin exonerarea persoanele fizice și juridice de obligația prezentării de către proprietarul bunurilor a certificatului Serviciului Fiscal de Stat privind lipsa sau existenţa restanţelor faţă de buget aferente bunurilor respective. Proiectul votat în lectură finală în ședința plenară din 3 mai a fost restituit Parlamentului spre reexaminare de către Președintele țării. Potrivit reprezentantului Președinției, Maxim Lebedinschi, documentul a fost restituit pe principii de oportunitate. Mecanisimul care funcționează în prezent nu a prejudiciat cetățenii. Procedura este simplă – un cetățean care dorește să înstrăineze un bun imobil, urmează să-și onoreze obligațiunile și față de bugetul de stat, a afirmat consilierul Președintelui. În același timp, autorii menționează în nota proiectului că Serviciul Fiscal de Stat nu deține un cadastru fiscal complet la nivel național din motiv că imobilele din sectorul rural nu au fost evaluate. Evidența acestor bunuri și a impozitelor aferente lor este ținută de serviciile de colectare a impozitelor și taxelor din primării, care, la rândul lor, nu dispun în totalitate de sisteme informaționale ce să permită notarilor accesarea informației cu privire la restanța impozitelor. Potrivit Președintei Comisiei juridice, Raisa Apolschi, certificatul menționat nu are impact asupra părților contractuale din motiv că evidența restanțelor este ținută după contribuabili. Schimbarea proprietarului nu duce la schimbarea subiectului restanței. Actualitatea proiectului reiese din necesitatea reducerii timpului și costurilor aferente înregistrării proprietății. Conform informației cu referire la metodologia Doing Business, înregistrarea proprietății în Republica Moldova, pentru persoanele juridice, presupune 5 proceduri, 5,5 zile și costă circa 0,9% din valoarea proprietății. Potrivit datelor oficiale, peste 400 mii persoane efectuează anual operațiuni cu bunurile imobile.
