Legea finanțelor publice și responsabilității bugetar-fiscale, completată

Autorităţilor și instituţiilor bugetare li se permite asumarea angajamentelor multianuale pe o perioadă de până la cinci ani în cazul achizițiilor de servicii sociale de alimentație în sistemul de educație, cu stipularea în cadrul contractului a obligației operatorului economic de a dota cantinele instituțiilor de învăţământ cu utilajul și echipamentul necesar pentru o bună funcționare, precum și de a asigura reparația spațiilor destinate cantinelor instituțiilor de învăţământ. Această prevedere este inclusă în Legea finanțelor publice și responsabilității bugetar-fiscale nr. 181 din 25 iulie 2014. Modificările au fost operate prin Legea nr.284 din 29 noiembrie 2018 pentru modificarea art. 66 din Legea nr.181. Documentul prevede punerea în aplicare a legii din data publicării – 4 ianuarie 2019. Amintim că acest proiect de lege a fost elaborat de Centrul pentru implementarea reformelor și a fost coordonat cu Cancelaria de Stat. Conform autorilor, modificarea dată va asigura respectarea calității produselor alimentare - de la materia primă și de la procesul de preparare până la produsul final. În același timp, utilizarea acestui mecanism va reduce costurile, care sunt suportate pentru întreținerea cantinelor și remunerarea salariaților. Aceste fonduri pot fi utilizate pentru compensarea altor cheltuieli necesare. Potrivit art.103 alin.(l) pct. 11) din Codul fiscal, produsele de fabricație proprie ale cantinelor studențești, școlare și ale cantinelor altor instituții de învățământ, ale spitalelor și instituțiilor preșcolare sunt scutite de TVA fără drept de deducere. De asemenea, de TVA sunt scutite şi produsele de fabricație proprie ale cantinelor care aparțin altor instituții și organizații din sfera social-culturală, finanțate parțial sau în întregime de la buget, precum și ale cantinelor specializate în alimentația persoanelor defavorizate, finanțate din contul organizațiilor de caritate.
