Legislația în domeniul concesiunilor va fi perfectată

Cadrul legal în domeniul concesiunilor va fi actualizat, inclusiv vor fi stabilite noi abordări în raport cu Legea cu privire la concesiuni, aplicabilă pentru realizarea proiectelor de interes public, creșterii eficienței și calității serviciilor și lucrărilor publice. Prevederile sunt incluse într-un proiect de lege, înregistrat în Parlament. Potrivit documentului, se propune stabilirea pragului valoric la atribuirea contractelor de concesiune, duratei minime și maxime de implementare a concesiunii, precum și modul de calculare a valorii estimative a concesiunii la etapa atribuirii contractului. La fel, în proiect este specificat expres că legea se aplică doar serviciilor cu caracter economic. Pentru concesiunile de lucrări sau servicii a căror valoare este mai mică decât pragul valoric prevăzut de lege, cu un termen de realizare mai mic de cinci ani, procedura de atribuire a contractelor de concesiune se va efectua printr-o procedură simplificată, conform normelor metodologice aprobate de Guvern. Proiectul stabilește și modalitățile de instituire a concesiunilor de lucrări și servicii, iar bunurile proprietate publică, determinate ca bunuri accesorii indispensabile lucrărilor și serviciilor ce fac obicetul contractului de concesiune, se transmit concesionarului de către autoritățile contractante, constituind, de asemenea, obiect al concesiunii. Documentul mai prevede determinarea competențelor autorităților publice în procedura de inițiere și implementare a concesiunilor. Tot aici se regăsesc clauze privind stabilirea redevenței și specificări privind dreptul de proprietate a autorității contractante asupra obiectului concesiunii și bunurilor accesorii acestora, precum și excepții aplicabile concesiunilor. De asemenea, documentul propune și abrogarea art. 2 alin. (5) din Legea privind achizițiile publice, care prevede aplicabilitatea legii în modul corespunzător formelor de parteneriat public privat neinterzise de lege, precum și în cazul atribuirii contractelor de concesiune de lucrări publice. Însă, legea nu prevede norme specifice de atribuire a contractelor de parteneriat public privat și concesiuni pentru Agenția Achiziții Publice.
