Мирное урегулирование ДТП

Парламентская комиссия по национальной безопасности, обороне и общественному порядку рассмотрела на заседании в среду, 19 сентября текущего года, поправки в Закон об обязательном страховании гражданской ответственности за ущерб, причиненный автотранспортными средствами. Они призваны упростить процедуру оформления ДТП в Республике Молдова. Проект предусматривает, что дорожные происшествия, повлекшие незначительный материальный ущерб, могут быть оформлены по упрощенной процедуре путем мирного урегулирования. Процедура мирного соглашения заключается в заполнении и подписании водителями транспортных средств, вовлеченных в ДТП, формуляра о мирном урегулировании происшествия, который включает признание вины и принятие ответственности виновной стороной. Формуляр о констатации ДТП путем мирного урегулирования предусматривает обязательное указание обстоятельств происшествия, персональные данные водителей и транспортных средств, данные полисов ОСОГО или сертификатов «Зеленая карта», описание нанесенного ущерба и другую необходимую информацию и оформляется в двух экземплярах с равной юридической силой. Бланки будет выдавать страховая компания при оформлении страхового полиса. В дальнейшем лицо, принявшее на себя вину, предоставляет страховой компании заполненный формуляр (вместе с заявлением о возмещении ущерба). Авторы законопроекта считают, что упрощенная процедура констатации определения виновной стороны в ДТП может стать альтернативой действующей процедуре, в ходе которой в разрешение ситуации вовлекаются представители МВД, прокуратуры, пожарные, что влечет значительные затраты материальных, временных и человеческих ресурсов. Также отмечается, что процедура мирного урегулирования будет применяться сторонами ДТП исключительно на добровольной основе и возможна при следующих обстоятельствах: в ДТП участвуют не более двух транспортных средств, ущерб нанесен только материальным ценностям и нет пострадавших. Обязательным условием станет и наличие у вовлеченных в ДТП владельцев транспортных средств действующих страховых полисов (ОСАГО или «Зеленая карта»), выданных не ранее чем за сутки до совершения ДТП. Предполагается, что новые правила мирного урегулирования вступят в силу при наличии ОСАГО через год, а при наличии «Зеленой карты» – через два, однако члены парламентской комиссии предложили сократить этот срок вдвое. Документ должен быть направлен для рассмотрения на пленарном заседании законодательного органа.
