Modificările propuse la Legea asociațiilor de economii și împrumut

Autoritățile propun ca fondul de stabilizare a asociațiilor de economii și împrumut să nu mai existe, iar în locul acestuia să fie instituit un Fond de garantare a depunerilor de economii a persoanelor fizice, modificând esențial și competențele acestuia. Așadar, Fondul de garantare se creează cu scopul de a garanta și rambursa depunerile persoanelor fizice, în cazul în care asociația se lichidează sau ajunge în insolvabilitate. Fondul de garantare va fi constituit din:
  • contribuțiile trimestriale ale asociațiilor, calculate de autoritatea de supraveghere , pentru a menține 1,0 la sută din suma totală a depunerilor de economii acoperite, înregistrate la bilanțul asociației la finele fiecărui trimestru și achitate în termen până la data de 15 a lunii următoare acestuia,
  • din veniturile și penalitățile de întârziere, aplicate asociațiilor, în mărime de 0,1 la sută din suma netransferată pentru fiecare zi de întârziere,
  • din contribuțiile speciale ale asociațiilor care nu pot depăși 0,5 la sută din depunerile de economii acoperite pe an calendaristic,
  • veniturile din investirea resurselor disponibile ale fondului de garantare a depunerilor de economii
  • mijloacele provenite din resursele Guvernului, din donații sau granturi.
Banii Fondului vor putea fi investiți în depozite bancare, valori mobiliare de stat și în instrumente financiare emise de BNM. Mai multe detalii, găsiți în proiectul de Hotărâre ce urmează să fie analizat la Guvern. Totodată, proiectul prevede reglementarea aplicării măsurilor de administrare specială, drepturile și obligațiile administratorului special, precum și încetarea administrării speciale.
