НКФР стала регулятором рынка небанковских кредитных организаций

На вчерашнем заседании Парламент Молдовы принял в окончательном чтении новый Закон о небанковских кредитных организациях. Положения документа направлены на обеспечение развития небанковского финансового сектора, расширения доступа физических и юридических лиц к финансовым ресурсам, обеспечение лояльной конкуренции, а также предупреждения чрезмерных рисков в рамках системы. Новый закон предусматривает повышение минимального уставного капитала НКО со 100 тыс. леев до 300 тыс. леев. Для выполнения этого требования установлен переходный период - 3 года: 1 января 2020 г. минимальный уставный капитал небанковской кредитной организации должен быть равен минимум 200 тыс. леев, а 1 января 2021 г. - не менее 300 тыс. леев. Также в процессе рассмотрения законопроекта в окончательном чтении были пересмотрены условия для проведения обязательного аудита годовых финансовых отчетов аудиторской компанией или индивидуальным аудитором-предпринимателем для небанковских кредитных организаций. Ранее аудит был предусмотрен для НКО, у которых стоимость активов которых на конец отчетного года превышает 25 млн леев. Сейчас этот показатель повышен до 50 млн леев. НКФР, которая ранее осуществляла мониторинг НКО, получает функции надзора на рынке небанковских кредитных организаций. Также в законе более детально описана процедура учреждения, регистрации и организации небанковских кредитных организаций, их реорганизации и ликвидации, требования относительно бухучета, финансовых ситуаций и специализированных отчетов, аудита и т.д. Напоминаем, что в настоящее время на рынке Молдовы зарегистрировани порядка 130 организаций микрофинансирования, которые составляют конкуренцию банковскому сектору. В 2016 г. их активы достигли 4,7 млрд леев. Предусмотрено, что закон вступит в силу с 1 июля текущего года.
