Новый закон о бухгалтерском учете

Правительство Молдовы одобрило проект нового Закона о бухучете. Этот документ будет актуализирован в соответствии с законодательством ЕС в области корпоративной финансовой отчетности. Как отмечают в Минфине, проект нового Закона о бухгалтерском учете устанавливает юридическую базу, оговаривает общие требования и механизм регламентирования бухучета и финансовой отчетности в Молдове. В отличие от действующего Закона о бухучете, положения нового документа будут распространяться и на постоянные представительства компаний нерезидентов, а также физические лица, которые занимаются индивидуальной деятельностью. При этом, исключены публичные учреждения, финансируемые из бюджета, поскольку их бухгалтерская и финансовая отчетность будет регулироваться Законом о публичных финансах. Таким образом, только госструктуры на самофинансировании будут обязаны впредь применять Закон о бухучете. В новом законопроекте все субъекты классифицированы по категориям (микро-, малые-, средние и крупные предприятия) и группам (средние, малые и крупные, в зависимости от доходов от продаж, общих активов и средней численности работников). Законопроект предусматривает три пакета финансовой отчетности (сокращенный, упрощенный, полный), в зависимости от категории и информационных потребностей субъектов, применяющих Национальные стандарты бухучета. Средние и крупные предприятия, представляющие публичный интерес, будут обязаны составить, наряду с финансовой отчетностью, доклад руководства. Доклад также предполагает и обязательность составления консолидированной финансовой отчетности материнской компанией, которая контролирует одну или несколько компаний. Относительно аудита финансовой отчетности, законопроект устанавливает его обязательность для средних и крупных предприятий, компаний, представляющих публичный интерес, и других компаний, согласно требованиям действующего законодательства, а также в случае консолидированной финансовой отчетности групп, которые обязаны их подготовить согласно законопроекту. Документ также содержит нововведения, касающиеся публикации индивидуальной финансовой отчетности, доклада руководства и доклада аудита, которые следует отправлять через электронную почту или загружать в систему публичного Депозитария финансовой отчетности. Таким образом, они будут доступны большему количеству потребителей информации. Также будет обязательной публикация на сайте компании всех финансовых отчетов, доклада руководства и доклада аудита компании, в которой проходила обязательная аудиторская проверка. Кроме внедрения требований европейских директив в области бухучета, в проекте Закона о бухучете актуализируются понятия, использующиеся в бухучете и финансовой отчетности, устанавливаются четкие требования по первичным документам и бухгалтерским записям, требования к лицам, ответственным за ведение бухучета и финансовой отчетности. Для внедрения нового закона потребуются расходы из госбюджета на разработку и приведения в соответствии с законопроектом Национальных стандартов бухучета и для развития платформы Депозитария финансовой отчетности. Планируется, что новый Закон о бухучете вступит в силу с 1 января 2018 г.
