Obligațiile angajatorului pentru protecția sănătății lucrătorilor expuși unui potențial risc în medii explozive

În vederea asigurării sănătății și securității lucrătorilor, angajatorul va fi obligat să ia măsuri tehnice și organizatorice privind prevenirea formării mediilor explozive, evitarea surselor care pot genera deflagrația mediilor explozive și limitarea efectelor dăunătoare ale unei explozii.
Proiectul hotărârii de Guvern cu privire la aprobarea Cerințelor minime pentru îmbunătățirea protecției sănătății și securității lucrătorilor expuși unui potențial risc în medii explozive a fost aprobat de Executiv.
 
Astfel, angajatorul evaluează riscurile specifice, luând în considerare probabilitatea producerii și menținerii mediilor explozive; instalațiile, substanțele folosite, procesele și posibilele lor interacțiuni; dimensiunile efectelor anticipate și probabilitatea existenței surselor de aprindere, inclusiv a descărcărilor electrostatice.

 

Totodată, angajatorul va clasifica locurile unde pot apărea medii explozive pe zone (Zona 0 - Zona 22) și va asigura elaborarea și actualizarea unui document privind protecția împotriva exploziilor, care va demonstra că sunt stabilite și evaluate riscurile explozive, locurile periculoase sunt clasificate pe zone, se aplică cerințele minime stabilite, locul de muncă și echipamentul de muncă, inclusiv dispozitivele de avertizare, sunt proiectate, realizate, adaptate și întreținute conform normelor de protecție a muncii.

 

Cerințe minime aprobate prin acest proiect nu se aplică:

  • în zonele utilizate direct pentru și în timpul tratamentului medical al pacienților;
  • la utilizarea dispozitivelor de ardere a combustibililor gazoși;
  • la producerea, manevrarea, utilizarea, depozitarea și transportul substanțelor explozive sau cu o structură chimică instabilă;
  • în industria extractivă,
  • la utilizarea mijloacelor de transport terestre, navale și aeriene cărora li se aplică dispozițiile relevante ale acordurilor internaționale la care Republica Moldova este parte;
  • la recipientele și vasele sub presiune care pot deveni sursa unei explozii.
