Organul fiscal poate să ridice documente sau mașini de casă la efectuarea controlului

În cadrul controlului fiscal, întreprinderea Dvs. poate fi reprezentată doar de administrator (director, director executiv etc.) sau un reprezentantul delegat de administrator. Directorul financiar sau contabilul-șef al întreprinderii nu substituie administratorul, decât dacă este împuternicit expres. În cazul unui control fiscal, asigurați-vă că fiecare angajat al întreprinderii:
  • va anunța imediat reprezentantul întreprinderii Dvs. despre inițierea controlului fiscal;
  • cunoaște că nu este autorizat să reprezinte întreprinderea în raport cu organul de control.
Mai mult, se recomandă să instruiți toți angajații întreprinderii în privința controlului fiscal – în special, explicați-le ce trebuie să întreprindă la venirea controlorului fiscal. De asemenea, trebuie să știți că organul fiscal este în drept să citeze orice persoană pentru a depune mărturii sau a prezenta documente . Citația este un înscris în care persoana este invitată la organul fiscal ca să depună documente sau să prezinte alt gen de informații relevante. Folosiți această listă de verificare pentru a verifica dacă în cadrul citării Dvs. sunt respectate regulile obligatorii prevăzute de lege. Organul fiscal poate ridica documentele şi/sau maşinile de casă şi de control în cazurile:
  • necesităţii de a proba prin documente încălcarea fiscală;
  • probabilităţii dispariţiei acestora;
  • în alte cazuri expres prevăzute de legislaţia fiscală.
Funcţionarii fiscali ridică documentele şi/sau maşinile de casă şi de control indiferent de apartenenţa şi de locul aflării lor, asigurând păstrarea lor în organul fiscal. În urma ridicării documentelor și/sau mașinilor de casă și control se întocmește proces-verbal. Ridicarea documentelor şi/sau maşinilor de casă şi de control se efectuează în prezenţa reprezentantului întreprinderii Dvs., iar dacă acesta lipseşte sau refuză să participe la procedura de ridicare, în prezenţa a doi martori asistenţi. Ulterior controlului fiscal, documentele și mașinile de casă și control ridicate vă vor fi restituite.
