Plafonarea taxei de stat pentru examinarea litigiilor patrimoniale ar putea fi eliminată

În Parlament este înregistrată o inițiativă legislativă ce are drept scop eliminarea plafonării la achitarea taxei de stat pentru cererile de chemare în judecată ce țin de litigiile cu caracter patrimonial, cererile de contestare a unui titlu executoriu sau a unui alt document, prin care încasarea se produce în mod incontestabil. În momentul de faţă, această taxă constituie 3% din valoarea acțiunii sau din suma încasată, dar nu mai puțin de 150 lei și nu mai mult de 25 mii lei de la persoanele fizice și nu mai puțin de 270 lei și nu mai mult de 50 mii lei de la persoanele juridice. În inițiativă se propune ca cuantumul tarifar al acestei taxe să fie 3% din valoarea acțiunii sau din suma încasată, în continuare nu mai puțin de 150 lei de la persoanele fizice și nu mai puțin de 270 lei de la persoanele juridice, însă plafonul maxim ar putea fi eliminat. În nota informativă se menționează că, potrivit unor analize efectuate în domeniu, anume plafonarea taxei de stat a fost una din cauzele care a permis unor organizații internaționale să-și legalizeze proveniența banilor prin intermediul sistemului judecătoresc din Republica Moldova.
