Поденщики обязаны заключить договор с НКСС

Национальная касса социального страхования (НКСС) напоминает поденщикам случайных неквалифицированных работ в сельском хозяйстве о положениях Закона 22/2018, в соответствии с которыми эта категория лиц обязана, на основании индивидуального договора, заключенного с НКСС, застраховаться в государственной системе обязательного социального страхования.
 
Для этого поденщик должен явиться в территориальную кассу социального страхования по месту жительства для заключения договора и уплаты взносов. Напоминаем, в 2020 г. этот тариф составляет 228 леев в месяц или 2736 леев за год, а период, за который уплачен взнос, является страховым периодом и предоставляет право на расчет пенсии по возрасту и пособия на погребение.
 
Действующее законодательство предусматривает, что отношения между поденщиком и бенефициаром работ устанавливаются по воле сторон и без заключения индивидуального трудового договора в письменной форме. Ежедневная продолжительность выполнения случайных неквалифицированных работ не может превышать восьми часов, а для несовершеннолетних поденщиков, в зависимости от возраста, от пяти до семи часов. Также следует учитывать, что ни один поденщик не может выполнять работы для одного и того же бенефициара в совокупности более 90 дней в течение одного календарного года.

 
Учет поденщиков ведет бенефициар, который обязан вести Реестр учета этой категории лиц в хронологическом порядке, на отдельных страницах, и представлять соответствующую выписку, до 15 числа каждого последующего месяца, территориальной инспекции труда, в зоне деятельности которой зарегистрирован бенефициар.
 
По приблизительным расчетам, порядка 30% населения Молдовы выполняет неквалифицированные работы временного характера, а 70% этих граждан занято на сельхозработах.
