Правительство утвердило проект закона о создании «Временного депозитария»

В Молдове создадут «Временный депозитарий» на шесть месяцев, пока Национальный банк и Министерство юстиции учредят свои депозитарии, необходимые для нормального функционирования рынка капитала. Как передает агентство «Инфотаг», такое решение принято на заседании правительства в среду. Автором законопроекта о временном депозитарии является Национальная комиссия по финансовому рынку (НКФР), предложившая меру для выхода из положения, чтобы дать возможность работать Фондовой бирже. Как пояснили корреспонденту «Инфотаг» в НКФР, в 2014 г. правительство взяло на себя ответственность перед парламентом за «пакет законов», в котором значился закон про создание двух депозитариев. Согласно закону, в Молдове должно быть два депозитария, учредителями которых должны быть Национальный банк и Министерство юстиции, которые до сих пор не созданы. По закону, депозитарий Национального банка должен заниматься ценными бумагами банков, а депозитарий Министерства юстиции – всеми остальными публичными бумагами. Поскольку закон вступил в силу, а депозитариев нет, Фондовая биржа оказалась парализованной из-за отсутствия депозитария, - сказал агентству «Инфотаг» представитель НКФР. По его словам, созданная правительством специальная комиссия призвана решить вопрос с учреждением депозитариев. Создание временного депозитария можно сравнить с вынужденным отступлением от требования действующего закона, правда, только на шесть месяцев, пока будут учреждены два депозитария, - отметил собеседник агентства. Профессиональные участники фондового рынка, мнением которых интересовался корреспондент «Инфотаг», говорят, что было бы лучше, если бы Молдова переняла опыт стран с развитым рынком капиталов, где депозитарий представляет частную структуру, учреждаемую участниками рынка.
