Proiectul modificărilor în Instrucțiunea privind evidența contribuabililor

Din 1 ianuarie 2021 a intrat în vigoare noua redacție a art. 167 din Codul fiscal, acesta fiind suplinit prin Legea nr. 257/2020 cu noțiunea  conturi de plăți. Articolul respectiv reglementează obligaţiile în cazul deschiderii, modificării sau închiderii conturilor bancare a părților implicate, inclusiv atribuțiile Serviciului Fiscal de Stat în cazul evidenței conturilor contribuabililor în instituţiile financiare (sucursalele sau filialele acestora).
 
Respectiv, cont bancar și /sau de plăți constituie un cont deschis în una din băncile (sucursala acesteia) din RM sau din străinătate și/sau din societățile de plată autorizare de Banca Națională a Moldovei participante la Sistemul Automatizat de Plăți Interbancare, precum și contul deschis în sistemul trezorerial al Ministerului Finanțelor.

 

 În acest context, Serviciul Fiscal de Stat propune spre consultare publică proiectul cu privire la modificarea Instrucțiunii privind evidența contribuabililor (aprobată prin Ordinul SFS nr. 352 din 28.09.2017). Astfel, și în Instrucțiune noțiunea cont bancar va fi substituită cu cea de cont bancar și/sau de plăți, care sunt deschise atât la bancă, cât și/sau la societatea de plată, societatea emitentă de monedă electronică.

 

 

SFS va confirma luarea la evidență fiscală a contului bancar și/sau contului de plată deschis prin emiterea Certificatului privind luarea în evidență a contului bancar /contului de plăți.

 

Totodată, autoritatea fiscală va recepționa informația aferentă conturilor bancare / conturilor de plată în conformitate cu art.14 alin (20) din Legea cu privire la prevenirea și combaterea spălării banilor și finanțării terorismului.
