Racordarea actelor normative la prevederile ce țin de reorganizarea IFPS, propus spre consultare

Ministerul Finanţelor a elaborat un proiect de lege care are drept scop racordarea unei serii de acte normative la prevederile ce ţin de reorganizarea Inspectoratului Fiscal Principal de Stat. Menţionăm că la 1 aprilie 2017 Serviciul Fiscal de Stat va fi creat prin reorganizarea Inspectoratului Fiscal Principal de Stat şi absorbția în acesta din urmă a inspectoratelor fiscale de stat teritoriale. Astfel, proiectul propune ca în actele normative care conțin denumirile „organ fiscal”, „inspectorat fiscal de stat teritorial”, „inspectorat fiscal de stat specializat”, „Inspectorat Fiscal Principal de Stat”, aceste noțiuni să fie substituite cu noțiunea „Serviciul Fiscal de Stat”. În acest sens se propune modificarea noţiunilor menţionate mai sus într-un şir de documente precum - Regulamentul sanitar pentru instituţiile de educaţie timpurie; Regulamentul cu privire la ţinerea Registrului garanţiilor reale mobiliare¸ Regulamentul privind atragerea investiţiilor în societăţile comerciale cu capital public sau public-privat; Regulamentul de utilizare a stemei, drapelului și culorii corporative a Serviciului Fiscal de Stat; Hotărîrea Guvernului privind activitatea serviciului de colectare a impozitelor și taxelor locale din cadrul primăriei etc. O altă modificare ce vine să îmbunătățească administrarea fiscală la compartimentul încasarea sumelor calculate de către Inspecția de Stat în Construcții se referă la excluderea din pct.34 al Regulamentului privind exercitarea controlului asupra utilizării investițiilor publice în construcții textului „Inspectoratului fiscal de stat teritorial de reşedinţă a organizaţiei de antrepriză care efectuează încasarea”, deoarece obligația respectivă nu reprezintă un impozit sau taxă în sensul prevederilor art.3 și 6 din Codul fiscal. Astfel, hotărârile emise de către Inspecția de Stat în Construcții urmează a fi remise direct spre executare către executorul judecătoresc competent.
