Se modifică Codul de procedură penală, după ce FISC-ul obține dreptul de constatare a 10 tipuri de infracțiuni

Ministerul Justiției propune o inițiativă legislativă prin care delegă Procuraturii dreptul de a declanșa urmărirea penală în cazul infracțiunilor depistate de FISC și care au fost săvârșite în proporții deosebit de mari. Potrivit Ministerului Justiției în competența procurorului ar urma să revină exercitarea urmăririi penale în cazul infracțiunilor constatate de FISC, dacă în urma ilegalității comise daunele aduse sunt în proporții deosebit de mari. În restul cazurilor, urmărirea penală revine Direcției Generale de Investigare a fraudelor economice din cadrul Inspectoratului General de Poliție. Autorul documentului motivează necesitatea operării modificărilor, după ce aprobarea unei Hotărâri de Guvern din luna aprilie care prevede mai multe competențe pentru FISC. Printre altele, este vorba despre constatarea mai multor infracțiuni economice, prevăzute în Codul penal. Așadar, potrivit acestui document autoritatea va avea dreptul de constatare a următoarelor tipuri de infracțiuni: • Practicarea ilegală a activității de întreprinzător (art. 241); • Pseudoactivitatea de întreprinzător (art. 242); • Evaziunea fiscală a întreprinderilor, instituțiilor și organizațiilor (art. 244); • Evaziunea fiscală a persoanelor fizice (art. 2441); • Transportarea, păstrarea sau comercializarea mărfurilor supuse accizelor, fără marcarea lor cu timbre de control sau timbre de acciz (art. 250); • Fabricarea ilegală a semnelor de marcare de stat, punerea în circulaţie şi utilizarea acestora (art. 2501); • Însuşirea, înstrăinarea în cazurile nepermise de lege, tăinuirea bunurilor gajate, luate în leasing, sechestrate sau confiscate (art. 251); • Insolvabilitatea intenționată (art. 252); • Insolvabilitatea fictivă (art. 253); • Falsul în documente contabile (art. 3351).
