Штраф для «Apă-Canal Chișinău» на 767 тыс. леев

Совет по конкуренции оштрафовал АО «Apă-Canal Chișinău» за нарушение законодательства о конкуренции и незаконное применение дифференцированного тарифа за услуги подключения к муниципальной канализационной системе сточных вод. Такое решение СК принял после рассмотрения обращения компании «Ivaro», которая пожаловалась на злоупотребление «Apă-Canal Chișinău» своей доминантной позицией на рынке и применение незаконных и непрозрачных тарифов. В частности, компания заявила, что «Apă-Canal Chișinău» обязал предприятие оплачивать услуги по предварительной очистке воды, хотя по факту отдельно эта услуга не предоставлялась, она включена в стоимость услуг по эвакуации сточных вод. За неуплату компанией «Ivaro» выставленной фактуры, поставщик услуг водоснабжения и канализации отключил предприятие от канализационной сети. Совет по конкуренции после проведенного анализа констатировал, что компания «Apă-Canal Chișinău» является единственным поставщиком канализационных услуг и, пользуясь этим положением, предоставила «Ivaro» счет-фактуру за непредусмотренные контрактом услуги. Согласно закону о публичной услуге водоснабжения и канализации, при сбросе хозяйствующими субъектами в канализационную систему населенного пункта сточных вод, объем и уровень загрязнения которых не превышают нормативы, утвержденные законодательством, применяются действующие на эту услугу тарифы. А если количество загрязняющих веществ превышает нормативы, то применяются дифференцированные тарифы, рассчитанные пропорционально указанным показателям нормативов, в соответствии с условиями договора. В отсутствие таких условий в обязательном договоре , плата осуществляется в госбюджет, в порядке, установленном Законом о плате за загрязнение окружающей среды. Совет по конкуренции наложил на АО «Apă-Canal Chișinău» штраф в размере 767 048,5 леев, которые предприятие должно уплатить в течение 60 дней.
