Штрафы за нарушение законодательства о конкуренции

Совет по конкуренции оштрафовал 12 компаний, которые нарушили законодательство в области конкуренции, на сумму более 2 млн леев. Речь идет о нескольких решениях пленума Совета. Компании «Cifrotech», «Interacces-M» и «Glamis» оштрафованы за отказ проведения проверки специалистами Совета по конкуренции. Штрафы составили 667,4 тыс. леев, 185,8 тыс. леев и, соответственно, 16,8 тыс. леев. Еще один экономический субъект - компания «BTS PRO» - оштрафован на 1,07 млн леев. Эта компания также ввела в заблуждение сотрудников Совета по конкуренции, не обеспечила доступ к ряду документов и к компьютерам сотрудников и др. В общей сложности, эти четыре компании должны перечислить в госбюджет штраф в размере 2 млн леев. Согласно законодательству, Совет по конкуренции может проводить необходимые проверки на предприятиях и в ассоциациях предприятий, а последние не должны препятствовать проведению проверки. Другим решением Совет по конкуренции оштрафовал восемь компаний, действующих на валютном рынке, за сговор при установлении обменного курса для операций с долларами и евро. Совет выявил наличие горизонтального антиконкурентного соглашения при установлении обменного курса между этими компаниями в течение всего периода наблюдения (с 1 января 2015 г. по 30 сентября 2016 г.). Законодательство предусматривает санкции за такие соглашения, направленные на прямое или косвенное установление цены покупки или продажи либо любых других условий заключения сделок. В результате, компании были оштрафованы почти на 45 тыс. леев: «Activ Prim» - на 16,7 тыс. леев, «Ramforinh» – на 15,1 тыс. леев, «Bartolomeu» – на 3,8 тыс. леев, «Lozcoz» – на 3,06 тыс. леев, «Olnast AG» – на 2,58 тыс. леев, «Lavronix» – на 1,9 тыс. леев, «Dragotin Prim» – на 1,4 тыс. леев, «Oanța-Schimb» – на 0,35 тыс. леев.
