Три новых разрешительных документа

Кодекс железнодорожного транспорта, проект которого кабмин утвердил и передал на рассмотрение парламенту страны, перелагает положения директивы Европарламента и Евросовета о создании единого европейского железнодорожного пространства и безопасности на железных дорогах, а также других европейских актов. Он предусматривает реорганизацию ГП «Железная дорога Молдовы» и упразднение монополии этого предприятия на рынке железнодорожных транспортных услуг. После вступления в силу нового кодекса услуги по перевозке пассажиров и грузов смогут предоставлять и частные операторы. Вместе с тем, вся железнодорожная инфраструктура будет принадлежать государству.  
 
В связи с этими поправками, Правительство одобрило изменения и и в Закон о регулировании предпринимательской деятельности, дополнив перечень разрешительных документов тремя новыми актами:
  • разрешение на железнодорожный транспорт,
  • сертификат безопасности для железнодорожных предприятий,
  • разрешение по безопасности для администратора  инфраструктуры.
Все три документа будет выдавать Железнодорожный орган, бесплатно, сроком на пять лет.
Кроме того, внесены поправки в Закон о госконтроле предпринимательской деятельности, в соответствии с которым Железнодорожный орган будет наделен контролирующими функциями. В частности, учреждение будет обеспечивать контроль за следующие области: безопасность железнодорожного транспорта; качество транспортных услуг,  защита прав потребителей услуг  железнодорожного транспорта;  охрана труда, соблюдение условий разрешений и сертификаций; соблюдение требований безопасности и качества железнодорожных транспортных средств, элементов железнодорожной инфраструктуры, железнодорожных сооружений, механизмов и технического оборудования, контроль соответствия компонентов интероперабельности с основными требованиями.
Эти изменения предприняты в связи с утверждением проекта нового Кодекса железнодорожного транспорта, который предусматривает создание Железнодорожного органа, уполномоченного выдавать разрешительные документы и осуществлять контроль за соблюдением условий их выдачи.
